Discovery, Mindset, Transformation Coaching and Support Services Pty Ltd

Introduction

These Terms of Service (“Terms”) govern your use of the services provided by Discovery, Mindset, Transformation Coaching and Support Services Pty Ltd (“DMTCSS”, “we”, “our”, or “us”). By accessing our website, booking an appointment, or engaging with any of our coaching or support coordination services, you agree to these Terms.

If you do not agree, please do not use our services.

Copyright and Intellectual Property

All materials, presentations, resources, frameworks, templates, and written content utilised across service provision or provided publicly remain the intellectual property of DMTCSS unless otherwise agreed in writing.

Plagiarising, selling or claiming resources owned by DMT without explicit approval is strictly prohibited and may result in legal action.

Services Provided by DMTCSS

  • Coaching Services

We offer personalised coaching sessions, group coaching, and workshops designed to support personal growth, mindset development, and positive change. Coaching is not counselling, psychology, or therapy. We do not diagnose, treat, or provide clinical advice.

  • Workshops & Group Services

Workshop content is educational in nature and designed to support learning, reflection, and discussion.

Participation in workshops does not create an ongoing coaching, therapeutic, or advisory relationship unless separately agreed.

Workshop materials remain the intellectual property of DMTCSS unless otherwise agreed in writing.

  • Support Coordination Services

We provide NDIS and Community Support services, including Support Coordination and assistance in implementing NDIS plans. Services are primarily focused on children, families, and individuals where DMTCSS has the skills, experience, and capacity to provide appropriate support.

Client Responsibilities

By using our services, you agree to:

  • Provide accurate, up-to-date information

  • Attend sessions on time

  • Participate actively in the coaching or support coordination process

  • Inform us of any changes to your contact details or situation

  • Seek appropriate professional or medical advice when required

  • Treat staff, contractors, and other participants with respect

  • Provide information necessary for us to safely and effectively deliver services

Payment Terms

  • Coaching

    • Coaching services are billed at the rate advertised at the time of booking unless otherwise agreed.

    • Payments are due within 7 days of invoicing unless agreed upon otherwise in writing.

  • Workshops

    • Workshop and team services are billed at the rate advertised at the time of booking unless otherwise agreed.

    • Payments for workshops and group bookings are to be made at least seven (7) days prior to any service delivery unless agree upon otherwise in writing. 

  • Support Coordination

    • Support Coordination services are billed in accordance with the current NDIS Pricing Arrangements and Price Limits.

    • Payments are due within 14 days of invoicing unless agreed upon otherwise in writing.

  • Late payments may result in suspension of services or delays in service delivery until the account is settled.

  • If payments are not settled within 45 days of the invoiced due date, then DMTCSS holds the right to engage third party agencies to support debt collection or take further legal action as required. 

  • DMTCSS reserves the right to recover reasonable costs associated with the recovery of overdue accounts, including debt collection costs, legal fees, and administrative expenses where permitted by law.

Cancellations & No-Shows

To ensure fairness to all clients:

  • Coaching appointments cancelled with less than 24 hours’ notice may be charged up to the full session fee if the slot cannot be filled.

  • No-shows may be billed at the full session rate.

  • Workshop cancellation terms may be specified separately in workshop proposals or service agreements.

  • NDIS cancellations will be charged in line with NDIS guidelines and as agreed upon in the signed Service Agreement document.

Limitations of Service

Coaching, Workshops and Support Coordination services:

  • Are not therapeutic, psychological, medical, or legal services

  • Do not guarantee particular outcomes

  • Provide guidance, strategies, and support but require client participation

  • You are responsible for your decisions, wellbeing, and actions.

Confidentiality

We maintain strict confidentiality in line with Australian Privacy Principles (APPs).

Your information will not be shared without your consent unless required by law, such as:

  • Risk of harm to yourself or others

  • Child safety concerns

  • Court orders or subpoenas

  • Professional, regulatory, safeguarding, or NDIS obligations where disclosure is required

Website Use

By accessing our website, you agree not to:

  • Use the site for unlawful purposes

  • Copy or reproduce website content without permission

  • Misuse booking or contact forms

All intellectual property on the site is owned by DMTCSS.

Third-Party Services

We may use third-party platforms such as:

  • Xero (invoicing, accounting)

  • Microsoft Outlook Calendar (scheduling and communication)

  • Zoom & Microsoft Teams (Virtual meetings)

By engaging our services, you acknowledge that some of your data may be processed or stored using these platforms.

Information may also be disclosed where required to meet professional, legal, safeguarding, child protection, NDIS, or regulatory obligations.

Limitation of Liability

To the extent permitted by Australian law, DMTCSS is not liable for:

  • Decisions you make based on coaching, workshop content or support coordination

  • Service interruptions beyond our control

  • Indirect, incidental, or consequential damages

Suspension or Termination of Services

DMTCSS reserves the right to suspend, decline, or terminate services where:

  • Services fall outside our scope of practice;

  • Safety concerns arise;

  • Payment obligations are not met;

  • Respectful engagement is not maintained; or

  • Continuing services would be inappropriate or unethical.
